No legal residence, but healthcare access: applying for coverage in Valencia

The health centre opens the case and issues provisional evidence. Municipal registration is not the only proof accepted, and a special route applies before three months.

A foreign national without legal residence in Spain does not have to wait for an emergency before entering the Valencian health system. Since March 2026 there has been a common national procedure, which the regional health authority processes at the reception desk of the nearest health centre. Filing produces provisional evidence allowing publicly funded care while the case is assessed.

The standard route is for people who are neither registered nor authorised as residents and can show at least three months of effective residence in Spain. They must not have healthcare through another route, be able to export coverage from their country of origin or have a third party liable for payment. They must not be recorded as insured or a beneficiary through the INSS or the Social Marine Institute.

Municipal registration helps, but is not the only proof

The form includes a responsible declaration and must be accompanied by a passport or official identity document from the country of origin. If neither is available, another government-issued document containing a photograph is accepted. For children without official identification, a birth certificate, family record or public evidence of guardianship can be used.

Habitual residence is normally shown with a current municipal registration certificate. Royal Decree 180/2026 prevents the absence of that certificate from closing access by itself. Alternatives include school enrolment, utility bills in the applicant’s name, consular registration, a certificate from a public migration centre or a record of visits issued by social services. The evidence must show actual residence, rather than a tourist stay.

Applicants from the EU or a country with a healthcare agreement may need a certificate from the competent institution confirming that coverage cannot be exported. The responsible declaration does not replace that certificate where it is required. If obtaining it is impossible for a justified reason, the Valencian system provides for social-work assessment.

The case is filed at the health centre

The reception desk supplies or accepts the official healthcare application. At that point the applicant should receive a SIP inclusion document showing provisional coverage and proof of registration. The decree also requires a genuine opportunity to start the process at the centre from the first episode of care; where the patient’s condition prevents this, the authority can open it on its own initiative.

The administration has three months to decide. Where the individual files the application, expiry of that period without a decision has the effect of approval; cases opened by the authority have refusal as their silence rule. A favourable entitlement does not expire unless healthcare later becomes available under another legal basis. It does not fund care outside Spain.

A refusal must be notified, and the Valencian information sheet gives 30 days for an administrative appeal. Changes to residence, visa, EU registration, home-country coverage or any other declared fact must be reported to the health centre. A material falsehood or omission can invalidate the document and lead to recovery of the cost of care.

People who have been in Spain for under three months, intend to live in the Valencian Community and are especially vulnerable follow a different route. They should request an appointment with a social worker at the health-centre desk; access requires a favourable prior report. This is an individual assessment of temporary stay and vulnerability, not an automatic waiver of the time requirement.
