A complaint form may not end the dispute: when to seek consumer arbitration

Arbitration is free and produces a binding award, but a prior complaint is required and the business may decline to participate.

Submitting a complaint form does not itself force a business to refund money or put a service right. If the reply is missing or inadequate, a consumer may request arbitration from the Valencian Consumer Arbitration Board. It is free and avoids ordinary court proceedings, but not every dispute is eligible.

A prior complaint is required

Attach the earlier complaint together with invoices, quotations, contracts, photographs or messages supporting the facts. State the remedy sought clearly, such as a refund, repair, performance or defined amount. Evidence without a clear request makes the case harder to assess.

Disputes between private individuals, business-to-business claims, matters already finally decided and cases involving injury, death, poisoning or possible crime are excluded.

Participation is not always automatic

A business already registered with the arbitration system has made a general commitment. Otherwise, the Board invites it to accept arbitration for that individual case. A refusal closes the arbitration file, although other routes remain available.

If the case proceeds, an arbitrator or panel is appointed and a hearing may be held. The resulting award is binding and enforceable, with effects similar to a court judgment. The normal period is 90 days from formal commencement, with a possible extension for complex cases.
