Castellón gains first option to buy protected homes before they leave public stock

The agreement lets the council match a specific sale, but every purchase will still require a municipal decision and funding.

Castellón City Council will be able to step into certain sales of protected housing and buy the property on the same terms agreed with a private purchaser. The local executive approved an agreement on 10 September transferring the Valencian government’s rights of first refusal and repurchase. It creates a route to expand municipal housing stock, but does not add any homes by itself.

The local decision completes a step announced months earlier. In March, the regional cabinet authorised agreements with Castellón and Alicante. The information published at the time set a four-year term, extendable for another four, and said homes acquired would enter the municipal public stock and remain permanently protected.

An option to buy, not an automatic purchase

First refusal allows the authority to step in before a sale and match the notified price and terms. Repurchase rights apply after a transfer in the circumstances set by law. Current Valencian government guidance gives a general 60-calendar-day period for repurchase after a correctly completed notification is received.

Transferring the rights to the council does not require it to buy every eligible home. Each case still calls for a valuation, a decision that the property suits public stock and enough municipal funding to pay for it. If the council declines a particular transaction, it must tell the regional government, which can regain the option to act on that property.

Radio Castellón reports that the mechanism applies to protected homes within the city boundary. It is not a general right over every flat sold in Castellón and does not impose a new restriction on all private housing.

Results will be visible in actual purchases

The agreement also requires the council to report on the progress and outcome of cases and provides for a monitoring commission. Those records will show whether the legal transfer produces more homes that residents can use.

The first acquisition, its price, the property’s intended use and the allocation criteria will be the first practical test. Until then, the agreement expands the council’s legal capacity but does not justify counting extra units in municipal stock.
